These terms are between you and Code Possession Pty Ltd, which operates Darg. By creating an account or an organisation you agree to them.
The service
Darg records when and where employees clock in and out, and shows those records to their organisation. Darg does not calculate pay and is not a payroll system.
Accounts
- Give accurate details and keep your password to yourself.
- You are responsible for what is done under your account.
- An employee uses Darg at the invitation of an organisation. The organisation controls its attendance records.
Organisations
If you create an organisation, you confirm that you may act for it. The organisation is responsible for:
- telling its employees that Darg records their location when they clock in and out, and meeting any workplace surveillance and privacy law that applies to it;
- the accuracy of its work locations, shifts and employee details;
- checking exported hours before using them for pay.
Free trial
A new organisation has a 14-day free trial. No card is needed. Each email address gets one trial. When the trial ends, clocking is unavailable until the organisation subscribes.
Fees
- The Basic plan costs A$5 per employee per month, or A$50 per employee per year. GST is added.
- You pay for each active person in the organisation, admins included, with a minimum of 5.
- Payment is taken in advance by card through Stripe. A subscription renews each month or year until it is cancelled.
- When the number of active employees changes during a billing period, the charge is adjusted for the days remaining. On monthly billing the adjustment appears on the next bill. On yearly billing, added employees are charged straight away, and removed employees become a credit against later bills. Credit is not refunded.
- We may change prices. We will give at least 30 days’ notice by email, and a change applies from your next renewal.
Cancelling
An admin can cancel at any time from the Subscription page. The subscription runs to the end of the period already paid for. We do not refund part periods, except where the Australian Consumer Law requires it.
Overdue payments
If a payment fails we will try again. If it stays unpaid, clocking becomes unavailable until payment details are updated.
Your data
The organisation owns its attendance records. We use them only to provide the service, as set out in the Privacy Policy. An admin can export attendance records as CSV at any time while the organisation has access.
Acceptable use
Do not:
- submit a false location or clock in for another person;
- try to access another organisation’s records;
- interfere with the service or test its security without our written consent;
- resell the service.
We may suspend an account that breaks these rules.
Availability
We work to keep Darg available but do not promise it will be uninterrupted. Location accuracy depends on the phone and its surroundings.
Liability
Nothing in these terms excludes rights you have under the Australian Consumer Law. Where the law allows us to limit our liability, it is limited to supplying the service again or paying the cost of having it supplied again.
Subject to that, we are not liable for indirect or consequential loss, or for pay decisions made from Darg records, and our total liability in any 12 months is limited to the fees the organisation paid in that time.
Ending
You can stop using Darg at any time. We may end or suspend access if these terms are broken or fees stay unpaid. To delete a personal account, see Delete your account.
Changes
We may change these terms. We will update this page and tell admins by email at least 30 days before a material change applies.
Governing law
These terms are governed by the law of New South Wales, Australia.
